Mombasa Governor Ali Hassan Joho is a happy man after his fierce opponent former Mombasa Senator Hassan Omar’s latest decision.

Hassan Omar has decided to withdraw his case from the courts, where he was challenging Governor Joho's victory in the August 8 gubernatorial election.

At the time of his withdrawal, Omar sighted lack of confidence in the court.

A few weeks ago, the former senator through his lawyer Yusuf Abubakar filled an application seeking the withdrawal of Lady Justice Achode's from hearing the matter while at the same time questioning her ability to serve justice accusing her of favoring Joho’s side.

Omar finished a distant third in the Mombasa gubernatorial race that was won by Joho.

The senator claimed that the Judge showed favour to Joho's team agreeing to grant applications by the Governor but refused to hear those he had filed after the judge stroke out some of the evidence he had provided. He also claimed that the judge entertained a myriad of irrelevant questions from Joho's legal team while granting them open latitude during cross-examination of their witnesses.

In his petition, Omar had claimed that there were massive irregularities committed during the poll in favour of Joho that affected the final outcome.

The former Senator has maintained that Judge Achode put up technical barriers to have the case invalidated.
