Embakasi East MP Babu Owino has said there is a deliberate and well crafted plan to ensure he loses his parliamentary seat.

Owino has spent the last three days locked up behind bars after he was arrested over derogatory utterance against the Presidency.

The MP is facing two charges of subverting justice and making statements to create disaffection against the Presidency.

Owino revealed that there are plans to make him miss eight consecutive parliamentary sittings by having him locked away in jail or in police custody.

According to the law, an MP who fails to attend eight straight parliamentary sittings will automatically lose his seat and a fresh by-election is called by the National Assembly Speaker.

"This plan was hatched on realisation that petition against me by one Francis Mureithi is a weak one and should it go through the said individual can never win with me on the ballot," Owino said on his Facebook page.

On Wednesday evening, Owino was dramatically re-arrested outside Milimani Law Courts over a past assault case during the legislator’s time as the University of Nairobi leader.

The MP was re-arrested shortly after he was freed on a Sh500,000 cash bail with two sureties of Sh1 million, after denying the charges levelled against him.

Owino’s team of lawyers, led by Siaya Senator James Orengo, had asked the court to grant him bail, but the prosecution opposed the application, arguing that Owino was a flight risk as he has no known fixed abode.

Police pounced on Owino moments after he walked to freedom at the Milimani Law Courts.
