The High Court has issued a new directive on night travel ban.

The court on Monday extended the earlier orders that adjourned the January ban on night travel.

The order that was enacted by National transport and Safety Authority (NTSA) was issued early this year following a case that was filed by one Okiya Omtatah an activist who challenged NTSA’s verdict to ban the night travel.

NTSA were instructed to file their response and appear in court for hearing slated for April 24 by Justice Chacha Mwita. NTSA were not represented in court.

Omtatah said that the ban was contrary to Article 232(1) (f) of the Kenyan constitution which requires provision to the public of timely and accurate information. He contends that the policy banning night travel for long distance PSV vehicles is vague.

Omtatah added that the ban is discriminatory, as it affects the long-distant travelers only. It therefore breaches Articles 27 of the constitution.

The night travel ban was lifted by NTSA Director Francis Mejja on New Year’s Eve in an attempt to curtail the number of accidents that had been on an alarming rise.

The popular ban raised havoc since the public did not take it so well.
