Lawyer files petition to kick out Njoki Ndungu from Supreme Court

Anxiety has engulfed the Supreme Court after a petition was filed to remove Justice Njoki Ndungu.

Lawyer Apollo Mboya filed a petition to the Judicial Service Commission seeking the removal of Ndung'u for negative attitude to colleagues during her ruling.

In the petition to the Judicial Service Commission, the lawyer said the judge exhibited "total lack of courtesy and civility towards her colleagues in the bench.”

Justice Ndungu together with Justice Jackton Ojwang dissented with the majority decision to quash the re-election of President Kenyatta.

She discounted key parts of the evidence that informed the decision of the majority opinion of the other four judges.

The judge faulted her colleagues for not using the certified forms filed in court by the IEBC to verify the allegations made by the petitioner, Nasa flag-bearer Raila Odinga.

Ndungu ruled that the majority opinion did not have the basis to overturn the election of President Kenyatta.

In her assessment, Mr Kenyatta was properly and validly elected as the president and the effect of the judgment was to deny Kenyans their right.
