Wajir Governor Mohamed Abdi has moved to the Court of Appeal to seek redress following a decision by the High Court to nullify his win during the August 8 General Election.

Following Governor Abdi’s appeal, the court suspended the nullification until the case is heard.

Irregularities

Presiding over the case last week, High Court judge Alfred Mabeya annulled Abdi’s win on grounds he was not legally cleared to be in the race.

The court ruled that Mr. Abdi, who vied on a Jubilee ticket, did not have a valid undergraduate degree certificate and that the election was marred by irregularities.

"In totality, the court hereby finds that the petitioners have succeeded in convincing the court that the election was not conducted in a free and fair manner,"  Justice Mabeya ruled.

The court ordered a by-election to be held in accordance with the constitution and electoral laws. The case was filed by former Wajir Governor Ahmed Abdullahi, who vied on an ODM ticket.

Governor Abdi goes on record as the first Governor to have his win nullified.
