Lawyer Assa Nyakundi's wife Lydia Nyakundi, on Friday filed a petition in court against DPP Noordin Haji for not being consulted when he decided to withdraw the manslaughter charges.
Lydia stated that she needed to be informed of any action that would be made in the case as she is involved in the matter as a witness.
“A declaration that the Petitioner’s role as a victim is active and includes the right to be well informed of any action that the Respondents desire to take in any criminal trial or proceedings preferred against the accused person in the murder of her son,” read a part of the document.
She further noted that Haji had violated her rights and that of her family by taking such a drastic action.
Lydia added that the prosecutors office had gone about the wrong way when they shared her name and that of her son as witnesses in the case.
DPP Haji withdraws manslaughter charges
DPP Noordin Haji on Thursday withdrew the case against Lawyer Assa Nyakundi from the Kiambu Court.
Senior Principal Magistrate Teresiah Nyongena, approved the application file by Haji to have the charges of manslaughter dropped after it was discovered that the case had been tampered with by two senior detectives carrying out the probe.
The move by the DPP came after DCI boss George Kinoti made the revelation in regards to the case where the lawyer is accused of shooting dead his son Joseph Bogonko Nyakundi.
