High Court Judge Jessie Lesiit on Friday made a surprise ruling in activist Carol Mwatha's murder case.
Justice Lesiit ruled to free the four suspects who had been detained in connection with the alleged botched abortion.
The judge explained that the prosecution had failed to justify any reason to continue to detain the suspects.
"I will grant the accused bail but with caution, failure to adhere to the terms, the bail shall be revoked and the accused persons shall not go to the New Njiru Clinic," Justice Lesiit stated.
The four were given the option of paying a Sh300,000 cash bail or a Sh500.000 bond.
Botched abortion
The released suspects are Betty Akinyi, her son Dale Richard Ramoya, Michael Onchiri, and Alexander Gitau who was said to have had an affair with Mwatha that led to a pregnancy.
Mwatha was missing for a week before her body was found at the City Mortuary.
A postmortem exam revealed that Mwatha had allegedly died from excessive bleeding which was a result of a botched abortion.
